Plaintiffs must fulfill all four (4) elements of defamatory statement that must be present in order to recover against a defamatory speaker: 1) a false statement purporting to be fact; 2) publication or communication of that statement to a third person; 3) fault amounting to at least negligence (i.e., defendant knew or should have known the statement was false); and 4) damages, or some harm caused to the person or entity who is the subject of the statement. These elements can sometimes be difficult to prove, especially damages, and an attorney can analyze all the relevant facts. Character defamation takes two forms: slander, which is spoken, and libel, which is written. The two may occur separately but are often found together.
Defamation of character isn’t universally actionable since in the U.S. we have the right to freedom of speech as enshrined in the 1st amendment of the constitution. As such, there are some exceptions. For example, public figures such as politicians, celebrities, etc. are “of the public interest” under the law and it can be difficult for a public figure to collect damages. Defamation cases therefore represent a balancing act of private and public interests, which should not be taken on without experienced representation.
